The Auctioneer has the right to reject any bid, to advance the bidding at his absolute discretion and, in the event of any dispute between bidders or any other issue with respect to the highest bidder, to determine the successful bidder, to continue the bidding or to re-offer and resell the house. In the event of any dispute after the sale, AUCTIONEER's record of final sale shall be conclusive. AUCTIONEER reserves the right to terminate the sale for any reason. The SELLER reserves the right to reject any and all bids. Title to the house shall pass to the Buyer upon the fall of the auctioneer's hammer and announcement by the auctioneer that the house has been sold, subject to compliance by the Buyer with all other conditions of sale. The Buyer shall forthwith assume full risk and responsibility for the house and shall pay the full purchase price on the date of the sale. In addition, the Buyer will be required to sign a Contract for Sale of House Separate from Real Estate. Subject to the foregoing, the house shall be removed from the SELLER’s premises at the Buyer's expense no later than September 1, 2018, and, if not so removed, the Buyer will incur a charges for storage and handling as follows, to-wit: $100 per day September 1 to September 14 $200 per day September 15 to September 30 $750 per day after October 1 Until house is removed from the Seller’s property. Bids which are submitted to AUCTIONEER in writing or are otherwise left with AUCTIONEER prior to an auction for execution at or below a specified price (Absentee Bids), as well as telephone bids & online bids shall be entertained and executed by AUCTIONEER for the convenience of bidders not present at auction, but AUCTIONEER shall not be responsible for failing to execute such bids or for errors relating to its execution of such bids. If the Buyer fails to comply with any of these Conditions of Sale, the SELLER may, in addition to asserting all remedies available by law, including the right to hold such defaulting Buyer liable for the purchase price: (i) cancel the sale, retaining as liquidated damages any payment made by the buyer, (ii) resell the property without reserve at public auction or privately on Twenty (20) days' notice to the Buyer, or (iii) take such other action as SELLER deems necessary or appropriate. If AUCTIONEER resells the property, the original defaulting Buyer shall be liable for the payment of any deficiency in the purchase price and all costs and expenses, including moving and storage, the expenses of both sales, reasonable attorneys' fees, commissions, incidental damages and all other charges due hereunder. In the event that such Buyer pays a portion of the purchase price, AUCTIONEER shall apply the payment received. Any Buyer who fails to comply with these Conditions of Sale will be deemed to have granted the SELLER a security interest in, and the SELLER may retain as collateral security for such Buyer's obligation to the SELLER, the home purchased by such Buyer. The SELLER shall have the benefit of all rights of a secured party under the Uniform Commercial Code adopted in the State of Kansas. The rights and obligations of the parties with respect to the Conditions of Sale and the conduct of the auction shall be governed and interpreted by the laws of the state of Kansas. By bidding at an auction, whether present in person or by agent, by absentee bid, telephone or other means, the Buyer shall be deemed to have consented to the exclusive jurisdiction of the courts of this state. The Buyer expressly agrees that: (i) neither AUCTIONEER nor the SELLER shall be liable, in whole or in part, for any special, indirect or consequential damages, including, without limitation, loss of profits, and (ii) the Buyer's damages are limited exclusively to the original purchase price paid for the house. The SELLER assumes no responsibility for acts or omissions in securing and insuring the home. Nor does the SELLER assume any responsibility for any damage to the house or the contents of the home. LIMITED WARRANTY The SELLER warrants that the house being sold is not subject to any liens.
