TERMS: THE HOUSE CONSTRUCTED BY THE CARPENTRY DEPARTMENT OF NORTH CENTRAL KANSAS TECHNICAL COLLEGE, WILL BE OFFERED FOR SALE BY HANSEN AUCTION & REALTY (AUCTIONEER) ON BEHALF OF NORTH CENTRAL KANSAS TECHNICAL COLLEGE (SELLER). REMOVAL: Buyers shall remove the House no later than September 1st, 2015. REMOVAL OF HOUSE AND PRESERVATION OF FOUNDATION: Buyers agree to remove the House from the above-described premises on or before September 1, 2018. Buyers will be responsible for all costs and liabilities associated with moving the House from the real estate in a timely manner. Buyers shall not damage or disturb the existing foundation when moving the House. If Buyers or any of Buyers’ agents damage or disturb the existing foundation or other assets of the Sellers that remain, then Buyers shall be responsible for all costs of repairing the Sellers’ assets. LIQUIDATED DAMAGES FOR DELAY – DELAY NOT CAUSED BY SELLERS: If Buyers fail to fully complete this Contract on or before September 1, 2018 then, for each day that this Contract shall remain uncompleted, including cleanup, after September 1, 2018, Buyers agree to pay upon Sellers’ demand, a daily fee as follows: $100 per day September 1 to September 14 $200 per day September 15 to September 30 $750 per day after October 1 WARRANTY: The SELLER warrants that the house being sold is not subject to any liens. Any claims by any Buyer involving this warranty must be made in writing to AUCTIONEER within THIRTY days of the date of sale. The Buyer's sole and exclusive remedy under this warranty against the SELLER shall be the rescission of the sale and the refund of the original purchase price paid for the house. Except for the warranty contained in this paragraph, all property is sold "as is" and Auctioneer and the SELLER make no other warranties, express or implied, including any warranty of merchantability, as to the property. Any comments made day of auction shall take precedence to any printed material. The property for auction will be the Carpentry House located at 3033 US 24 Hwy, Beloit Kansas, excluding the foundation, heating / air conditioning unit and stairs. As used in these Conditions of Sale, the term "final bid price" means the amount of the highest bid acknowledged by the auctioneer and the term "purchase price" means the sum of the final bid price plus SALES TAX. The highest bidder acknowledged by the auctioneer shall be the Buyer. The Auctioneer has the right to reject any bid, to advance the bidding at his absolute discretion and, in the event of any dispute between bidders or any other issue with respect to the highest bidder, to determine the successful bidder, to continue the bidding or to re-offer and resell the house. In the event of any dispute after the sale, AUCTIONEER's record of final sale shall be conclusive. AUCTIONEER reserves the right to terminate the sale for any reason. The SELLER reserves the right to reject any and all bids. Title to the house shall pass to the Buyer upon the fall of the auctioneer's hammer and announcement by the auctioneer that the house has been sold, subject to compliance by the Buyer with all other conditions of sale. The Buyer shall forthwith assume full risk and responsibility for the house and shall pay the full purchase price on the date of the sale. In addition, the Buyer will be required to sign a Contract for Sale of House Separate from Real Estate. Subject to the foregoing, the house shall be removed from the SELLER’s premises at the Buyer's expense no later than September 1, 2018, and, if not so removed, the Buyer will incur a charges for storage and handling as follows, to-wit: $100 per day September 1 to September 14 $200 per day September 15 to September 30 $750 per day after October 1 Until house is removed from the Seller’s property. Bids which are submitted to AUCTIONEER in writing or are otherwise left with AUCTIONEER prior to an auction for execution at or below a specified price (Absentee Bids), as well as telephone bids & online bids shall be entertained and executed by AUCTIONEER for the convenience of bidders not present at auction, but AUCTIONEER shall not be responsible for failing to execute such bids or for errors relating to its execution of such bids. If the Buyer fails to comply with any of these Conditions of Sale, the SELLER may, in addition to asserting all remedies available by law, including the right to hold such defaulting Buyer liable for the purchase price: (i) cancel the sale, retaining as liquidated damages any payment made by the buyer, (ii) resell the property without reserve at public auction or privately on Twenty (20) days' notice to the Buyer, or (iii) take such other action as SELLER deems necessary or appropriate. If AUCTIONEER resells the property, the original defaulting Buyer shall be liable for the payment of any deficiency in the purchase price and all costs and expenses, including moving and storage, the expenses of both sales, reasonable attorneys' fees, commissions, incidental damages and all other charges due hereunder. In the event that such Buyer pays a portion of the purchase price, AUCTIONEER shall apply the payment received. Any Buyer who fails to comply with these Conditions of Sale will be deemed to have granted the SELLER a security interest in, and the SELLER may retain as collateral security for such Buyer's obligation to the SELLER, the home purchased by such Buyer. The SELLER shall have the benefit of all rights of a secured party under the Uniform Commercial Code adopted in the State of Kansas. The rights and obligations of the parties with respect to the Conditions of Sale and the conduct of the auction shall be governed and interpreted by the laws of the state of Kansas. By bidding at an auction, whether present in person or by agent, by absentee bid, telephone or other means, the Buyer shall be deemed to have consented to the exclusive jurisdiction of the courts of this state. The Buyer expressly agrees that: (i) neither AUCTIONEER nor the SELLER shall be liable, in whole or in part, for any special, indirect or consequential damages, including, without limitation, loss of profits, and (ii) the Buyer's damages are limited exclusively to the original purchase price paid for the house. The SELLER assumes no responsibility for acts or omissions in securing and insuring the home. Nor does the SELLER assume any responsibility for any damage to the house or the contents of the home.
