1. THE TERMS AND CONDITIONS GIVEN ARE A BINDING CONTRACT. By registering to bid live and/or on the Internet, you agree to abide by all terms and conditions, and you acknowledge receipt of all explanations and information made available by Hiatt Auction LLC. 2. ONLINE PURCHASE All successful purchases will be automatically debited from the credit card on file at the end of the sale. This will include a 10% buyers fee and applicable sales tax. Any tax-exempt business must supply the 2021 Kansas sales tax exempt form prior to bidding. Please contact us to email the correct copy -these must be updated annually. 3. BUYER'S PREMIUM A 10% buyer's premium will be added to all winning bids, resulting in the total purchase price. Your Internet bids are a contract, and you are responsible for honoring them. 4. SALES TAX / USE TAX State law requires Hiatt Auction LLC to collect sales tax on all transactions. If your purchase qualifies for tax exemption you will be required to fill out the Kansas State form prior to bidding. Bidders must advise of exemption status and fill out form at registration. 5. BID AND BIDDER QUALIFICATION PROCESS. All bidders must register with form of payment (credit or debit card) being used. INFORMATION ON CARD MUST MATCH BIDDER INFORMATION. Bidders with prior history of nonpayment at auctions will be excluded from bidding. Hiatt Auction reserves the right to cancel any Internet bid if the bidder refuses or fails to timely cooperate with the auction company's efforts to verify the bidder's qualification to bid. By registering to bid in this auction, you authorize your confirmation of credit references, credit card companies and financial institutions to Hiatt Auction LLC. Please note: Please register before the day the auction ends or you will risk your bid not being accepted. We verify all bidder's eligibility prior to accepting bids. 6. INTERNET BIDDING This is an Internet-only auction, which means the highest bid online when the bidding closes on an item will be the winning bid for that item. Bidding for items will begin to close every 20 seconds. The items will close in the order listed on the website. This auction will feature our automatic extension system which will grant a (3) minute extension to the end of the auction of any item receiving a bid during the last three (3) minutes. The item will then close when three (3) minutes have elapsed without any bidding activity. All items are selling without reserve, and all Internet bids are treated as if they were given at a live auction. All bidders will be held accountable for their Internet bids. Hiatt Auction reserves the right to cancel any Internet bid if the bidder refuses or fails to timely cooperate with the auction company's efforts to verify the bidder's qualification to bid. We may contact first time bidders to confirm they understand the terms and conditions. 7. ITEMS SOLD AS IS. PREVIEW IS ENCOURAGED. All assets, unless stated otherwise, are sold "as-is, where is". Unless we stated on the lot "Tested Works" the item may not have been tested. We strongly encourage buyers to preview items or to contact us for more information prior to bidding. Buyers assume all risks at the conclusion of the auction. All sales are final. No refunds given. Credit card transactions may not be reversed. Although mostly intact some items are used and might have pieces missing that we are not aware of. Listings include written descriptions, photographs. Equipment descriptions are based on our direct observation and information provided by the consignor. All information is intended to be as accurate as possible. Again-we recommend customers inspect prior to bidding. Information given regarding the items listed are not intended to be substitutions for inspection. An error or omission in the listing will not change the results of the bid. It is the responsibility of the buyer to conduct any inspection and examination necessary to satisfy him of all material facts before placing a bid. Inspection prior to bidding. INVOICING AND PAYMENT INFORMATION Invoices will be emailed to winning bidders at the conclusion of the auction event after payment is automatically debited with the exceptions listed: Any invoice totals over $3,000 and for out of area buyers will need to be paid via wire to our financial institution. It is a simple process which must be done no later than noon the next business day after the sale. PLEASE plan with your financial institution prior to bidding. All local invoice totals under $3,000 will be debited from the credit card given at registration. All successful transactions will be emailed a paid invoice. Forms of payment accepted: MasterCard, Visa, and Discover are accepted only for charges up to $3,000, and only after authorization (via website or email) or in-person signatures are obtained from the cardholder. Unsuccessful credit card transactions will result in immediate contact to resolve payment. Please contact us prior to the sale if you would prefer a wire transfer to our bank. Please verify with your bank or credit card company if you need to raise your card limit prior to bidding. Failure to pay by the payment deadline noted in these terms and conditions will result in an additional administrative fee equal to 10% of the winning bid price (minimum $20.00 fee) per invoice. After the payment deadline, Hiatt Auction LLC may also declare the asset abandoned, resulting in additional costs and potential losses to the buyer. Defaulting customers will lose all bidding privileges with Hiatt Auction LLC. Hiatt Auction reserves the right to charge the credit card on file the total purchase price and a $30 late payment fee will be added for invoices not paid within our terms. Payment should be made to Hiatt Auction LLC Hiatt Auction LLC reserves the right to hold assets until funds availability is confirmed. 10. ASSET REMOVAL PICKUPS AND SHIPPING. Please be courteous and schedule your appointment as soon as possible. Please keep your appointment time. After receiving paid invoice buyer may call for appointment for removal. You may call after 2PM Saturday to schedule youor pick up. PICK UP TIMES: MONDAY 1:30 -6:30 TUESDAY 9 A.M.-6:30 P.M. WEDNESDAY 9AM-6:30. Call 913-271-3045 to schedule your appointment. FAILURE TO PICKUP by designated dates will result in daily storage of $10 per lot per day up to 7 days. After that items will be considered abandoned and will be disposed of at auctioneer's discretion. Bidder will not be allowed to bid at future auctions. Storage fees will be applied to any items not picked up by Wednesday after the auction. Specific exceptions will be made to schedule container/Conex pick-ups. OUT OF AREA BUYERS: Out of area buyers are responsible for arranging packing and shipping on all items that can be shipped or they can pick up. Shipping prep and transport for parcels available for additional service fee. Please note we will prep and ship parcels and freight after Wednesday. Shipments 50# or less will be shipped USPS unless a Fed Ex or a UPS tag is provided by the buyer. Parcel prep fee is $20 per 50#. Any items over 50# must be shipped with a freight carrier. Charges for freight prep $50 per pallet. If shipping or having an agent pick up items purchase payment must be made by wire transfer. All shipping arrangements must be made by email. Please contact us prior to scheduling freight pickups. If you need assistance getting a quote for shipping please contact us via email. Fees will be added in the case of a missed freight pick-up. Failure to remove an asset by the removal deadline noted in these terms and conditions ("Removal Default") will result in an additional administrative fee equal to 10% of the winning bid price (minimum $10.00 fee), plus storage fees of $10/day until the asset is ultimately removed from the auction site. After the removal deadline, Hiatt Auction LLC may also declare the asset abandoned resulting in additional costs and potential losses to the buyer.. PAYMENT DEFAULT AND REMOVAL DEFAULT ARE NOT INCLUSIVE OF EACH OTHER AND MAY BE ADDED TOGETHER.
